The natural stream channel from the confluence of Swede Gulch in
the SE/4, NW/4, Sec. 36, T4S, R71W, 6th P.M. as the upstream
terminus and extending to the Harriman Ditch Headgate in the
NE/4, NE/4, NE4, Sec 2, T5S, R70W 6th P.M. as the downstream
terminus, being a distance of approximately 8.2 miles. This
segment can be located on the Evergreen and Morrison U.S.G.S.
quadrangles and is depicted on Exhibit A.

5. Use of the water:

Instream flow to preserve the natural environment to a reasonable degree.

6. Date of initiation of appropriation:

September 13, 1994.

. 7. The water was first applied to the above beneficial use on September 13, 1994, by
action of the Colorado. Water Conservation Board under the provision of C.R.S. ~ ~ 3 ~ -92-102(3),
37 -92-103(3 ),(4),( 1 0).

THE COURT HEREBY DECREES:

The application is granted and a decree (ABSOLUTE) in the amount of 15.0 c.r.s. (April
I - October IS); 7.0 c;f.s.(October 16 - March 31) is hereby entered to preserve the natural envi-
ronment to a reasonable degree through the upstream and downstream points as described in
paragraph 4 above. The appropriation date for this water right is September 13, 1994.
