The source of the water is: <br /> <br />Bear Creek, tributary to the South Platte River. <br /> <br />4. <br />claimed. <br /> <br />Legal description of the stream segment through which an instream flow is <br /> <br />The natural stream channel from the confluence of Swede Gulch in <br />the SE/4, NW/4, Sec. 36, T4S, R71W, 6th P.M. as the upstream <br />terminus and extending to the Harriman Ditch Headgate in the <br />NE/4, NE/4, NE4, Sec 2, T5S, R70W 6th P.M. as the downstream <br />terminus, being a distance of approximately 8.2 miles. This <br />segment can be located on the Evergreen and Morrison U.S.G.S. <br />quadrangles and is depicted on Exhibit A. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 13, 1994. <br /> <br />. 7. The water was first applied to the above beneficial use on September 13, 1994, by <br />action of the Colorado. Water Conservation Board under the provision of C.R.S. ~ ~ 3 ~ -92-102(3), <br />37 -92-103(3 ),(4),( 1 0). <br /> <br />8. . Amount of water claimed (ABSOLUTE): Instream flow of 15.0 c.f.s. (April 1 _ <br />October IS); 7.0 c.f.s. (October 16 - March 31). <br /> <br />THE COURT HEREBY DECREES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 15.0 c.r.s. (April <br />I - October IS); 7.0 c;f.s.(October 16 - March 31) is hereby entered to preserve the natural envi- <br />ronment to a reasonable degree through the upstream and downstream points as described in <br />paragraph 4 above.
