STIPULATION

IN THE MATTER OF THE APPLICATION F:OR WATER RIGHTS OF THE
COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE PEOPLE
OF THE STATE OF COLORADO,

IN JEFFERSON COUNTY, COLQRADO.

Applicant, the Colorado Water Conservation Board (IICWCBII), and Evergreen
Metropolitan District ("Evergreen"), stipulate and agree as follows:

I. 'Evergreen agrees to the entry of a decree in this case that is no less restrictive than
the draft decree dated Febuary 2,2000. '

2. The CWCB intends to operate its water rights, as sought herein, within the '
Colorado prior appropriation system and recognizes the water righ~ which were the
subject of Evergreen's application in Case No. 94CWl50 to be senior to the water rights
sought in this action.
