The source of the water is: <br /> <br />Bear Creek, tributary to the South Platte River. <br /> <br />4. <br />claimed. <br /> <br />Legal description of the stream segment through which an inStream flow i~ <br /> <br />The natural stream channel from the outlet of Evergeen Lake at <br />latitude 39037'55"N and longitude 105019'19"W as the upstream <br />terminus and extending to the confluence of Swede Gulch in the <br />SE/4, NW/4, Sec. 36, T4S,R71 W 6th P.M. as the downstream <br />terminus, being a distance of approximately 4.0 miles. This seg- <br />ment can be located on the Evergreen U.S~G.S. quadrangle and is <br />depicted on Exhibit A. <br /> <br />For the stream segments in an unsurveyed area, the Division <br />Engineer has determined for administrative purposes that the <br />approximate legal description of the instream flow termini as <br />protracted from U.S.G.S. and/or U.S.F.S. mapping is as follows: <br />upstream terminus in the SW/4, NE/4, Sec 10, T5S, R71W, 6th <br />P.M., 2,400 feet from the North line and 2,200. feet from the East <br />line. . <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 13, 1994. <br /> <br />7. The water was first applied to the above beneficial use on September 13, 1994, by <br />action of the Colorado Water Conservation Board under the provision ofC.R.S. 9~ 37-92-102(3), <br />37-92-103(3),(4),(10). <br /> <br />2 <br />
