Neville agrees to the entry of a decree in this case that is no less restrictive than the draft <br />decree attached as Exhibit A. <br /> <br />2. This stipulation shall be binding upon the parties hereto, their successors, and assigns. <br /> <br />3. Neville shall remain on the mailing list in this case and shall be provided with a copy of any <br />proposed ruling and/or decree in this matter. <br /> <br />4. This stipulation will be submitted to the Water Court for Water Division 2 <br />with the request that it be approved by, and become enforceable as, an order of the court. <br /> <br />5. This Stipulation is entered into by way of compromise and settlement of this <br />litigation and any agreement contained herein by the CWCB shall not be construed as a <br />commitment to include any specific finding of fact, conclusion ofIaw or specific engineering <br />methodologies or administrative practices in future stipulations. Both Applicant and <br />Objector agree this Stipulation shall bind and benefit them and will be binding upon and <br />benefit their heirs, assigns and successors in interest; however, except as may be expressly <br />provided in any decree which may be entered by the Water Court in this matter, individuals <br /> <br />,. ~,-"._l.. <br />
