Date of initiation of appropriation: <br /> <br />November 3,1994. <br /> <br />E. The water was first applied to the above beneficial use on November 3, 1994, by <br />action of the Colorado Water Conservation Board under the provision of C.R.S. SS 37-92-102(3), <br />37-92-103(3),(4),(10). <br /> <br />F. Amount of water claimed (ABSOLUTE): Instream flow oD.OO c.f.s. (April I - <br />July 15); 0.75 c.f.s. (July 16 - March 31). <br /> <br />THE COURT HEREBY DECREES: <br /> <br />Based upon and fully incorporating herein the findings off act set forth above, this Court <br />concludes and decrees the following: <br /> <br />The proposed application is authorized by the Water Right Determination and <br />Administration Act of 1969, C.R.S. S S 37-92-101, et seq. (1999) and can be implemented in <br />accordance with said statute. <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount oD.OO c.f.s. (April <br />1 - July 15); 0.75 c.f.s. (July 16 - March 31) is hereby entered to preserve the natural environ- <br />ment to a reasonable degree through the upstream and downstream points as described in <br />paragraph 4 above. The appropriation date for this water right is November 3, 1994. <br /> <br />The priority herein awarded was filed in the water court in the year of 1994 and shall be <br />junior to all priorities filed in previous years. As between all rights filed in the same calendar <br />year, priorities shall be determined by historical date of appropriation and not affected by the <br />date of entry of ruling. The Applicant shall install and maintain such measuring devices and <br />keep such records as the Division Engineer may require for administration of this right. <br /> <br />Dated this <br /> <br />day of <br /> <br />,2000. <br /> <br />3 <br />
