Jay contract with the ditch company, the diversion is limited <br />to 50 cts. <br />~ This is anon-decreed Indian water right diverted through this structure. When the river goes on administration, this water right <br />receives a full storage allotment. <br />During administration of the river, the water commissioner only administers the first three of <br />the Indian water rights (124.62 cfs). The remaining water rights are downstream and are <br />generally satisfied by return flows from upstream irrigation. <br />The Southern Ute Indian Tribe is entitled to 1/6 of the active storage in Vallecito Reservoir or <br />approximately 20,900 acre-feet. However, because of the senior priority date associated with <br />the Indian ditches, the historical project storage releases to these structures are typically less <br />than 5,000 acre-feet per year. <br />The remaining users of prof ect water from Vallecito Reservoir are the stockholders of the Pine <br />River Irrigation District. Each year, the District makes a determination of the amount of prof ect <br />water that will be available, with consideration of the existing storage levels and anticipation of <br />the projected runoff. The resulting allocation to each shareholder is then based on the number <br />of Project acres irrigated by that individual divided by the total project acreage (non-Indian). <br />Typically, the allocation ranges from 2.0 to 2.5 acre-feet per acre. This can be estimated by <br />dividing the non-Indian portion of the active capacity (104,500 acre-feet) by the approximate <br />number of irrigated acre (42,779 acres). For purposes of administration, the District then <br />aggregates the project entitlements of the individual stockholders on the basis of the ditch <br />structure that serves them. In this manner, the Project storage entitlements for each of the major <br />ditch structures are estimated as follows: <br />San Juan & Dolores River Basin Information 2-20 <br />
