Space is typically available when Louisville's decrees are in priority <br />because FRICO is fairly junior on South Boulder Creek and Louisville is fairly senior. <br />When Louisville needs the canal, FRICO is usually out-of-priority so there is excess <br />capacity. When FRICO is diverting to storage in the wintertime and early spring, <br />Louisville's transferred irrigation decrees are generally not in priority. Louisville must <br />supply FRICO twenty percent of all foreign direct flow water diverted through the <br />Community Ditch directly to the Louisville treatment plant. <br />FRICO also entered into an agreement with the City of Westminster and the Eagle Golf <br />Corporation on February 8, 1993. The "Westminster Agreement' specifies that 475 Church <br />Ditch inches owned by FRICO and previously used at times in the Marshall Lake Division <br />would be reduced and eliminated. FRICO was also to proportionately retire up to 127.231 <br />Marshall Lake Division shares as treasury shares. <br />FRICO also has Community Ditch carriage agreements with the Town of Superior and right-of- <br />way agreements with the City of Broomfield, the Interlocken District, and the Rock Creek <br />District. These agreements were formed to accommodate development within these entities. <br />Reservoir Accounts: There were a total of 1406.21 shares in the Marshall Lake Division prior to <br />the Westminster Agreement which requires up to 127.231 shares to be retired to the <br />treasury, leaving 1278.979 issued shares.
