Permits a junior well diverter to withhold making replacements of well depletions otherwise <br />required pursuant to a plan of augmentation during the nonirrigation season if the division <br />engi neer determines that downstream senior reservoirs will fill even in the absence of such <br />replacements. Requires such replacements to occur if the division engineer later determines that <br />such reservoirs will not otherwise fill. Authorizes the state engineer to adopt a rule or the <br />division engineers to adopt a policy for procedural requirements for applications to withhold the <br />replacement of well depletions during nonirrigation season, including evidentiary requirements, <br />notice, opportunity to comment, hearing s, whether formal or informal, and the right to an appeal. <br /> <br />Status <br /> <br />02/01/2008 Introduced In Senate - Assigned to Agriculture, Natural Resources & Energy <br />03/05/2008 Senate Committee on Agriculture, Natural Resources & Energy Postpone <br />Indefinitely <br /> <br /> <br />BILL SB08 - 168 <br /> <br /> <br /> <br />CONCERNING THE SPECIES CONSERVATION TRUST FUND, AND, IN CONNECTION <br />THEREWITH, APPROVING THE SPECIES CONSERVATION ELIGIBILITY LIST, <br />ADJUSTING PREVIOU SLY - APPROVED TRANSFERS AND APPROVALS, AND <br />MAKING APPROPRIATIONS. <br /> <br />Short Title: <br /> Species Conservation Trust Fund <br />Sponsors: <br /> ISGAR / CURRY <br /> <br />Appropriates money from the species conservation trust fund (trust fund) for programs submitted <br />by the executive directo r of the department of natural resources that are designed to conserve <br />native species that have been listed as threatened or endangered under state or federal law, or are <br />candidate species or are likely to become candidate species as determined by the Unit ed States <br />fish and wildlife service. With regard to transfers from the operational account of the severance <br />tax trust fund to the trust fund: <br />* Delays, from the 2007 - 08 fiscal year to the 2008 - 09 fiscal year, a transfer of one - half of the <br />revenues that ac crued to the severance tax trust fund that exceeded the March 2007 revenue <br />forecast for the severance tax trust fund; <br />* Delays, from fiscal year 2007 - 08 to fiscal year 2008 - 09, the transfer of $1,000,000; and <br />* Makes transfers of revenues that would othe rwise have been appropriated for a deep <br />underground science and engineering laboratory (DUSEL) occur in the same fiscal year as the <br />appropriation for DUSEL would have occurred rather than in the succeeding fiscal year. <br />Transfers $917,000 from the capital a ccount of the trust fund to the operations and maintenance <br />account of the trust fund that was previously approved for expenditure in connection with the <br />Platte River Three State Cooperative Agreement. Authorizes the expenditure of $500,000 in <br />fiscal year 2 009 - 10 from the operation and maintenance account of the species conservation trust <br />fund for acquiring the minimum amount of water for instream flows necessary to preserve or <br />improve the natural environment to a reasonable degree for species of concern. <br />
