Reqmnts Dev Lowry Bombing Range

Prohibits any development of land located in Arapahoe county constituting all or any portion of
the site of the former Lowry bombing and gunnery range (Lowry site) until either all
environmental remedial decisions governing the site are complied with or the state r eceives
moneys from the federal government or any other responsible parties in an amount sufficient to
pay for the costs of complying with all such remedial decisions. Requires every contract for the
purchase and sale of residential real property that is l ocated on the Lowry site to contain a
disclosure statement in bold - faced type that is clearly legible and that substantially provides
notice that the property is located in a formerly used defense site that may contain unexploded
ordnance and that the qual ity of potable water for the real estate may be unreliable. Specifies that
the obligation to provide the disclosure set forth in the act is on the seller and, in the event of the
failure by the seller to provide the written disclosure required by the act, the purchaser shall have
a claim for relief against the seller for all damages to the purchaser resulting from the failure plus
court costs.

CONCERNING A LIMITED EXEMPTION FOR WATER COLLECTED FROM
RESIDENTIAL ROOFTOPS.

Au thorize Domestic Exempt Cisterns

Authorizes the use of a cistern that collects rainwater from up to 3,000 square feet of the roof of
a primary residence that is a single - family dwelling if the water thus collected is used for:
* Ordinary household purposes;
* Fire protection;
* The watering of poultry, domestic animals, and livestock on farms and ranches; and
* The irrigation of not over one acre of gardens and lawns. Declares it to be the policy of the
state that the cistern e xemption is intended to allow citizens to obtain a water supply in less
densely populated areas for in - house and domestic animal uses where other water supplies are
not available. Specifies that cistern owners may be required to develop plans for augmentat ion.
