water in acre-feet conveyed through the Ditch on orders of purchasers thereof bears to the total

RAGGED MOUNTAIN WATER USERS' ASSOCIA nON ( Association)

Contract No. 96-07-40'-R2050, dated July 18, 1996:

Article 4. "Unless the United States or the District has notified the Association that water is not
available in any given year, the Association shall pay the District an annual payment of $1200.00
as a water service charge on or before December 1 following the irrigation season for the right to
divert 2,000 acre-feet of water during that season. In addition, the Association shall reimburse the
District on or before December 1, an appropriate share of operation and maintenance costs as
determined by the District. The Association agrees to pay said sums regardless of wether it used
the entire 2,000 acre-feet or not." (Note, This contracts expires July 18, 2002. )

NORTH FORK W ATt:R CONSERVANCY DISTRICT (District), FIRE MOUNTAIN
CANAL: FIRE MOUNTAIN CANAL AND RESERVOIR COMPANY ( Company) and
LEROUX CREEK WATER USERS' ASSOCIATION ( Association)

Contract No. 14-06-400-4650, dated May 12, 1967:

This is a water exchange contract only. The stockholders in the Association located below the
Fire Mountain Canal extension turned in their Association stock and Leroux Creek water rights
to the Association and received stock in the Company equaling the same amount of water. The
Company is entitled to receive from the Paonia Project the project water contracted to the
Association under the District! Association contract. The Association accepts the turned in
stock and water in lieu of its right to receive the contracted project water. The Association has
the right to dispose of the stock and water above the Company's canal and below the canal only
after exhausting its opportunity to do so above the canal. The Association also agreed the Leroux
Creek water for all intents and purposes shall be regarded as the project water made available to
the Association under the Paonia Project.

The District, Company and Association all agreed to maintain the integrity of the existing
contracts between.

This contract does not change any of the existing repayment or O&M obligations between the
District, Company and Association.
