"Unless the United States or the District has notified the Association that water is not <br />available in any given year, the Association shall pay the District an annual payment of $1200.00 <br />as a water service charge on or before December 1 following the irrigation season for the right to <br />divert 2,000 acre-feet of water during that season. In addition, the Association shall reimburse the <br />District on or before December 1, an appropriate share of operation and maintenance costs as <br />determined by the District. The Association agrees to pay said sums regardless of wether it used <br />the entire 2,000 acre-feet or not." (Note, This contracts expires July 18, 2002. ) <br /> <br />NORTH FORK W ATt:R CONSERVANCY DISTRICT (District), FIRE MOUNTAIN <br />CANAL: FIRE MOUNTAIN CANAL AND RESERVOIR COMPANY ( Company) and <br />LEROUX CREEK WATER USERS' ASSOCIATION ( Association) <br /> <br />Contract No. 14-06-400-4650, dated May 12, 1967: <br /> <br />This is a water exchange contract only. The stockholders in the Association located below the <br />Fire Mountain Canal extension turned in their Association stock and Leroux Creek water rights <br />to the Association and received stock in the Company equaling the same amount of water. The <br />Company is entitled to receive from the Paonia Project the project water contracted to the <br />Association under the District! Association contract. The Association accepts the turned in <br />stock and water in lieu of its right to receive the contracted project water. The Association has <br />the right to dispose of the stock and water above the Company's canal and below the canal only <br />after exhausting its opportunity to do so above the canal. The Association also agreed the Leroux <br />Creek water for all intents and purposes shall be regarded as the project water made available to <br />the Association under the Paonia Project. <br /> <br />The District, Company and Association all agreed to maintain the integrity of the existing <br />contracts between. <br /> <br />This contract does not change any of the existing repayment or O&M obligations between the <br />District, Company and Association. <br />
