Contract No. 14-06-400-688 dated November 14, 1964 (Amendment # 2)

Article 8 amended Article 16 of Contract No. Ilr-1536, June 11, 1948 :( Operation &
Maintenance By District) " The District shall, at its own cost and expense, when notified by the
Secretary so to do, operate and maintain all or any part of the project works" (Note: District
was notified on June 1, 1962) .

Contract No. 11r-1536" dated June 11, 1948 :

Article 17 (Assessmerits for Leroux Creek and Fire Mountain Irrigation Blocks) "The District
agrees that contracts entered into for use of project water will provide that comparative
construction charge assessments for use of project water in the Leroux Creek Irrigation Block
and Fire Mountain Irrigation Block shall be in the ratio of 1 to 2.45, respectively, The District
further agrees that such contracts shall provide that operation and maintenance assessments
payable to the District or the United States for the operation and maintenance ofthe project
works, or any part thereof, in the Leroux Creek and Fire Mountain Irrigation Blocks need not be
equal and uniform, but may be higher in one block than in the other."

FIRE MOUNTAIN CANAL: :fIRE MOUNTAIN CANAL AND RESERVOIR COMPANY

Contract No. 11r-1537l dated August 9, 1948:

.Article 11 (Operation and Maintenance of Canal) " The Company shall retain the management,
control, operation and maintenance of the Fire Mountain Canal as reconstructed, relocated,
enlarged and extended and the District shall, on or before April 151 of each year, pay to the
Company that proportion of the estimated cost of operation and maintenance thereofwhich the
quantity ofPaonia Project water conveyed through the said canal bears to the total quantity of
water so conveyed." ,

Article 6 (Terms of Payment ) The Company purchased 8,100 acre-feet of project water from
the District and agreed to pay the District $ 1,647,084.00 over 68 years.
