<br />, <br />, <br /> <br />-, <br />, <br /> <br />,# <br /> <br />November 25, 1996 <br /> <br />Re: Natural Resources Conservation Service October 31, 96 Meeting on Funding Mu- <br />tual Mesa Lateral: <br /> <br />To: Whom It May Concern. <br /> <br />From: Shareholders Opposing Tactics Used to Obtain Public Funds for MML. <br /> <br />The purpose of this memo is to clarify the position of those opposing the tactics being <br />used by Orchard Mesa Irrigation District to obtain funding for Mutual Mesa Lateral. <br /> <br />At the meeting held October 31, 1996 project opponents were asked if they objected to <br />the placing of Mutual Mesa Lateral in piped lining. The answer is no. By custom OMID <br />has assumed responsibility for the operation and maintainence of this lateral. <br /> <br />Our exception is in the means of financing it. Orchard Mesa Irrigation District is re- <br />quired by law to acquire debt in a specified manner. The prescribed requirements are <br />stated in the Colorado Statutes and in the Federal Code of Regulations. If OMID is <br />found to have spent any amount of illegally gotten public (grant or loan) funds without <br />full compliance with these laws, shareholders will seek relief through the district court <br />under Rule 106. <br /> <br />Issuers of public funds for this project have known of these tactics for at least 18 <br />months, and have willfully allowed OMID to proceed. If they do not immediately witl- <br />draw these funds pending OMID's full compliance, they will be named as defendants in <br />this legal action. <br /> <br />All persons in attendance at this ex parte meeting are publicly notified that it appears <br />they are actively involved in a sham transaction, and have subjected themselves to this <br />pending legal action. <br /> <br />In addition to those in attendance at the October 31 st meeting, the following persons <br />appear to be involved in these tactics: Duane Johnson, Priscilla L. Porter, Wilda L. <br />Grant, Milton Slone, Jeff Vonk, Thomas L. Japhet, Larry Clark and Stu Shelton, all with <br />USDA. <br /> <br />In addition, the executive director for Colorado Natural Resources, The Colorado Water <br />Conservation Board and William P. Stanton will receive this memo. <br /> <br />The solicitor General for USDA and Colorado, will each receive a copy, as will Flint B. <br />Ogle and the County Committee for Mesa County Farm Services. <br /> <br />mtngmemo <br />
