Public <br />notice was given that OMID's feasibility study was completed September 20, <br />1996, or about two years after design completion, and fifteen months after the <br />Governors approval. <br /> <br />Comment: It is clear that the eWeB staff made an ex parte decision to <br />waive the requirement that a feasibility study be prepared before seeking ap- <br />provals. Also, eWeB's staff knew NReS had prepared the design plan before <br />the loan request. This means the MML feasibilitv stud v is intentional deception to <br />hold OMID landowners responsible for repavina a loan issued bv public emplov- <br />ees for the benefit of owners of a private aolt course. <br />Anv licensed professional enaineer aareeina to prepare an after-the-fact <br />document to obtain public funds must be viewed as directlv aidina and abettina <br />intentional cover-up of the issuance of fraudulent aovernment contracts. This <br />conclusion is easily reached when one discovers a letter written by this profes- <br />sional advising how to alter accounts to alleviate a taxpaying landowners com- <br />plaints. <br /> <br />What Is It? <br />(In no particular order) <br /> <br />· If aMID is a local government, how can it form MMLE by board resolution? <br /> <br />· How can MMLE be formed without approval of the County Commissioners, <br />the court, and a vote by OMID landowners? <br /> <br />. <br /> <br />· How can aMID form an enterprise if it doesn't issue stock? <br /> <br />· If OMID is issuing stock, as some documents show, why can't I sell or trans- <br />fer my shares for use at other locations? <br /> <br />· If aMID is not a government, why does it certify to the Department of Local <br />Affairs that it's revenue is obtained from taxes collected by Mesa County? <br /> <br />· What rule of law gives MMLE authority to use OMID's Federal tax 10 number, <br />and State sales tax exemption number? <br />rn <br />· What rule of law gives MtLE authority to charge aMID fees? <br />I <br /> <br />· aMID has contracts with the United States, Public Service Company, and the <br />Grand Valley Water Users Association for the carriage of water to MML us- <br />ers. If it can be proven that MMLE is a legal enterprise, do these contracts <br />have to be amended to include MMLE? <br /> <br />17 <br />
