Mr. and Mrs. Rooks continue to live on this farm three years after this an- <br />nouncement. <br /> <br />January 11, 1993, OMID manager Rooks signed an agreement with Chepita Golf <br />Course Inc. concerning irrigation water, open drains, and the burvinQ of that <br />seQment of MML crossinQ this Qolf course. This agreement is in the form of a <br />letter addressed to the Mesa County Commissioners. The reason for this <br />agreement has not been established. However, one must think Mesa County <br />required the closing of MML as a condition of rezoning the proposed golf course <br />property from agricultural - Forestry - Transitional (AFT) to Planned Unit Devel- <br />opment (PUD). <br /> <br />Comment: Irrigation District law of 1905 under which aMID was formed, <br />authorizes elected a designated board member, not a paid employee to execute <br />agreements for aMID. <br /> <br />December 15, 1993 Emery C. Johnson, SCS Area Conservationist, and James <br />D. Rooks, OMID manager, conducted a status revue of MML. The review docu- <br />ment shows OMID owns the land MML serves. <br /> <br />October 17, 1994 Jeff Burwell, SCS Area Conservationist, and James D. Rooks, <br />OMID manager, conducted a status revue of MML. The review document shows <br />OMID owns the land MML serves <br /> <br />On the fifth day of December 1994, John Van Sciver, CWCB staff planner, pro- <br />vided OMID manager James D. Rooks an application for a construction loan <br />from the Coloradq Water Conservation Board (CWCB), stating in the accompa- <br />nying memo that the loan would be used to line an OMID ditch. <br /> <br />In a January 13, 1995 memo to the CWCB board John Van Sciver advised that <br />he had met with NRCS planners and engineers to tour the proposed MML proj- <br />ect on January 9th. The names of the Natural Resources Conservation Service <br />(NRCS) planners and engineers on this tour are not known. <br /> <br />In this January 13th memo, Mr. Van Sciver wrote that NRCS had prepared an <br />enQineerinQ plan durino 1992. and that aoency had estimated the total proiect <br />cost at $1,500,000. He noted that he found NRCS's cost estimate satisfactory, <br />and that NRCS had prepared an environmental assessment and found no sig- <br />nificant impact. The board was told that Jim Rooks would be present at the <br />January 25th. CWCB Board meeting to discuss the project with them. <br /> <br />At OMID's January 25, 1995 annual meeting, manager Rooks asked landowners <br />to approve a loan from CWCB for $1,000,000 to convert the entire 21.500 foot <br />MML to a closed system. (The OMID annual meeting was held the same day as <br />the CWCB board meeting.) Landowners were told that NRCS had estimated the <br /> <br />4 <br />
