July 28, 1998 Ms. Gale A. Norton, Attorney General State Of Colorado 1525 Sherman Street Denver, Co. 80203 Dear Ms. Norton: Enclosed is a copy of a letter I have written to Frank Daniels, Mesa County District Attorney, requesting prosecution of government employees for intentionally falsifying public documents in a manner that has caused injury to me and all Orchard Mesa Irrigation District (OMID) landowners. These government employees include Ms. Linda Bassi and C. Richard Pennington of your law office. Ms. Bassi is the attorney of record for the three court cases referenced in the letter to Mr. Daniels. Mr. Pennington is the attor- ney that approved the loan contract referenced in that letter. Also, Mr. Daniels has been asked to investigate John Van Sciver, Jan lI- lian, Bill Green, Mike Serlet, and William Stanton for altering documents to as- sure issuance of the loan Mr. Pennington approved. As I understand, your office represents these Colorado Water Conservation Board (CWCB) employees. I draw your attention to statements made by Bill Frey, OMID attorney, at the January 25, 1996 OMID annual meeting, and again at an October 31, 1996 special meeting (regarding issuance of a salinity control grant). The minutes of these meetings show that Mr. Frey said that he and (unknown) persons within your office opined OMID was not subject to Amendment #1. Enclosed is a copy of a fax transmittal cover sheet to Linda Bassi from Flint B. Ogle. Mr. Ogle and Mr. Frey jointly represent OMID in this matter. Mr. Ogle's faxing Ms. Bassi documents associated with the issuance of the CWCB loan suggests she is the unknown person within your office Mr. Frey is referring to when opining at these meetings OMID is not subject to Amendment #1. Also, I have enclosed a copy of a letter dated April 26,1996 to me from William Stanton. The second paragraph of this letter states that my complaints to him about the CWCB loan injuring me was being reviewed by your office and that the loan would not be issued to OMID until OMID had submitted a detailed , feasibility study of the Mutual Mesa Lateral (MML) project. 1
