<br />STATE OF COLORADO <br />DEPARTMENT OF NATURAL RESOURCES <br />WEATHER MODIFICATION RULES AND REGULATIONS <br />EFFECTIVE SEPTEMBER 12, 1973 <br /> <br />These rules and regulations are issued pursuant to Section <br />36-20-105(2) C.R.S. 1973 of the "Weather Modification Act of 1972". This <br />section empowers the Executive Director of the Department of Natural <br />Resources, in consultation with his Weather Modification Advisory <br />Committee," . . . to issue rules and regulations he finds necessary to <br />facilitate the implementation of this article . . ." These rules and <br />regulations are intended to supplement and clarify certain of the <br />sections of the Act. <br /> <br />I. Licensing <br /> <br />(A) The minimum requirements for a license under the "Weather <br />Modification Act of 1972" 36-20-107(2)(b) i, ii, iii, iv) C.R.S. 1973 <br />will constitute the requirements for a weather modification licensE~. <br /> <br />(B) Form WM1, or equivalent information, should be provided in making <br />application. To assure timely consideration this should be submitted at <br />least 45 days prior to any intended use. <br /> <br />(c) All licensees wil be required to pay the $100 license fee. <br />Waivers for the license fee will not be made for research and <br />governmental projects. <br /> <br />(D) Weather modification licenses will be reviewed annually. <br />Renewal will be automatic upon (1) receipt of a request for renewal by <br />the license holder, (2) receipt of the $100 annual license fee, and <br />(3) verification by the Executive Director of the Department of Natural <br />Resources that evidence has not become available that would raise <br />legitimate doubts as to the qualifications of the license holder. <br /> <br />II. Permits <br /> <br />(A) The information requested on State of Colorado Form WM2 must be <br />provided in making application for a State of Colorado Weather <br />Modification Permit. <br /> <br />(B) A liability policy of $1 million can serve as one means of <br />establishing financial responsibility. Proof must be provided that the <br />insuring company is authorized to do business in Colorado. <br /> <br />(c) Permit applications should be submitted at least 45 days prior to <br />the initial date of the requested operation period for which the permit <br />is sought. <br /> <br />(D) Every licensee applying for a permit to conduct a specific <br />weather modification operation within the state shall publish a Notice of <br />Intent to Modify Weather in accordance with the following provisions. <br /> <br />89 <br />
