3. The Commission hereby agrees: (a) To authorize the Bureau of Reclamation to proceed with implementation of the weather modification project including the award of a contract to effectuate the purposes of this agreement; (b ) To arrange coordination among the parties, the Bureau of Reclamation, and the contractor; (c ) To provide facilities support and assistance as needed by the contractor; (d) To provide data regarding the Gatun and Madden Lakes watershed and surrounding area; and (e) To monitor the project and assist in its assessment. 4. IRHE hereby agrees to consider any and all claims presented for injury or damages that occur within the Bayano watershed area as a result of the weather modification project. The Commission agrees to consider, in accordance with its statutory authority concerning such matters, any and all claims for injury or damages that occur outside the Bayano watershed area as a result of the weather modification project. 5. IRHE will appoint a representative to coordinate the technical aspects of the project. IRHE reserves the right to cancel proposed seeding operations in the Bayano watershed area. IRHE hereby agrees to pay, as its share of the cost of the project, the sum of $25,000 or 1/6 of the total cost, whichever is less. The Commission hereby agrees to pay, as its share, the balance of the cost of the project. The Commission shall make financial arrange. ments with the Bureau of Reclamation for payments of the costs. IRHE shall remit its share of the costs upon proper billing by the Commission. 7. The weather modification project shall terminate on or before August 16, 1983 unless one of the following provisions is applied: (a) At any time prior to August 16, 1983, either party may, after 15 days' written notice and consultation with the other party, with, draw from the project. Costs to the date of termination shall be determined and assessed in accordance with the ratios set forth in Paragraph 5. (b) The project may be continued beyond the August 16 termi. nation date by mutual consent of the parties. 8. The definition of terms used in this agreement shall be those set forth in Annex No.1 attached hereto and incorporated herein by reference. IN WITNESS WHEREOF, the parties have executed this agreement in triplicate in the Spanish and English languages, both being equally authentic. The following definitions shall be applied to the terms used in the Agreement: A. Weather Modification. The intentional altering of atmospheric conditions. B. Cloud-seeding. The introduction of chemi- 18 cals into certain clouds so as to stimulate rain- fall. C. Contractor. The person or firm actually per- forming cloud seeding operations in the Republic of Panama pursuant to a contract with the Bureau of Reclamation.
