<br />3. The Commission hereby agrees: <br /> <br />(a) To authorize the Bureau of Reclamation to proceed with <br />implementation of the weather modification project including the <br />award of a contract to effectuate the purposes of this agreement; <br /> <br />(b ) To arrange coordination among the parties, the Bureau of <br />Reclamation, and the contractor; <br /> <br />(c ) To provide facilities support and assistance as needed by the <br />contractor; <br /> <br />(d) To provide data regarding the Gatun and Madden Lakes <br />watershed and surrounding area; and <br /> <br />(e) To monitor the project and assist in its assessment. <br /> <br />4. IRHE hereby agrees to consider any and all claims presented for <br />injury or damages that occur within the Bayano watershed area as <br />a result of the weather modification project. The Commission <br />agrees to consider, in accordance with its statutory authority <br />concerning such matters, any and all claims for injury or damages <br />that occur outside the Bayano watershed area as a result of the <br />weather modification project. <br /> <br />5. IRHE will appoint a representative to coordinate the technical <br />aspects of the project. IRHE reserves the right to cancel proposed <br />seeding operations in the Bayano watershed area. <br /> <br />INSTITUTO DE RECURSOS <br />HIDRAULICOS Y ELECTRIFICACION <br /> <br />(s) Victor Urrutia <br /> <br />6. IRHE hereby agrees to pay, as its share of the cost of the project, <br />the sum of $25,000 or 1/6 of the total cost, whichever is less. The <br />Commission hereby agrees to pay, as its share, the balance of the <br />cost of the project. The Commission shall make financial arrange. <br />ments with the Bureau of Reclamation for payments of the costs. <br />IRHE shall remit its share of the costs upon proper billing by the <br />Commission. <br /> <br />7. The weather modification project shall terminate on or before <br />August 16, 1983 unless one of the following provisions is applied: <br /> <br />(a) At any time prior to August 16, 1983, either party may, after 15 <br />days' written notice and consultation with the other party, with, <br />draw from the project. Costs to the date of termination shall be <br />determined and assessed in accordance with the ratios set forth in <br />Paragraph 5. <br /> <br />(b) The project may be continued beyond the August 16 termi. <br />nation date by mutual consent of the parties. <br /> <br />8. The definition of terms used in this agreement shall be those set <br />forth in Annex No.1 attached hereto and incorporated herein by <br />reference. <br /> <br />IN WITNESS WHEREOF, the parties have executed this agreement <br />in triplicate in the Spanish and English languages, both being equally <br />authentic. <br /> <br />Executed at Panama City, Republic of Panama this 10th of May, 1983. <br /> <br />PANAMA CANAL COMMISSION <br /> <br />(s) John J. Plunkett <br /> <br />I <br />j <br /> <br />ANNEX NO.1 <br /> <br />Definitions. The following definitions shall be applied <br />to the terms used in the Agreement: <br /> <br />A. Weather Modification. The intentional <br />altering of atmospheric conditions. <br /> <br />B. Cloud-seeding. The introduction of chemi- <br /> <br />18 <br /> <br />cals into certain clouds so as to stimulate rain- <br />fall. <br /> <br />C. Contractor. The person or firm actually per- <br />forming cloud seeding operations in the <br />Republic of Panama pursuant to a contract <br />with the Bureau of Reclamation. <br />
