As you kno\', , the Trinidad Project water users are in the middle
of the five year development or "shake down" period as it is sometimes
called. One of the questions that has clrisen is 'Ihow should the State

In behalf or Trinidad

and the Purgatoire River Water Conservancy District, the legal firms
of Davis, Graham and Stubbs, and Moses, Wittemyer, Harrison and
Woodruff, and the engineering firms of Zorich-Er~er and W. W. Wheeler
and Associates have jointly studied and researched this subject. In
this letter we would like to present to you the results of our work
and propose methods by which you could administer the Purgatoire River
in accordance with the conditions imposed in the Model transfer decree.
In Civil Action No. 19793, which i~ the Model Reservoir transfer
decree, the following limitation was imposed:

That the Petitioners' storage of water in
the Trinidad Reservoir under the Model Reservoir
Right shall be regulated in such a manner that
the quantity of water occurring in the Las Animas
or Purgatoire River at a gauging station on said
river below Von Bremmer Arroya shall remain and
be the same, as determined by the State Engineer,
during any period of ten consecutive years reckoned
in continuing progressive series beginning with
January I, 1954 as it would have been had the
Model Reservoir Right not been transferred to the
Trinidad Reservoir.
