<br />'.-. <br /> <br />The language to which this comment was directed f read as follows: <br /> <br />(3) . . .; provided that water not so required to be stored <br />shall be released from Lake Powell: (i) to the extent it can be <br />reasonably applied in the States of the Lower Division to the <br />uses specified in Article III (e) of the Colorado River Compact, <br />(ii) to maintain as nearly as practicable active storage in Lake <br />Mead equal to the active storage in Lake Powell, (fi) to avoid <br />anticipated spills from Lake Powell, and: Prqvided 1 further, <br />That no releases under this subparagraph (3) shall be made <br />when the active storage in Lake Powell is less than the active <br />storage in Lake Mead. (This was the language of H . R. 4671, <br />draft of January 27, 1966.) <br /> <br />The language of Section 602 became a part of H .R. 3300 in the <br /> <br />90th Congress, 2d Session, and the House Report on said bill, being <br /> <br />House Report No. 1312, 90th Congress 1 2d Session, explained Section 602 <br /> <br />at pages 84 through 87. [That language is included herein as Appendix 3.J <br /> <br />Basically there is not a great deal of change from the House Report <br /> <br />of the previous Congress, above mentioned. In this report the House <br /> <br />Interior Committee characterizes the clauses herein descri.bed as "three <br /> <br />specific operating criteria I" and again the Committee stated that perhaps <br /> <br />under criterion (ii) there may be need to operate Lake Powell over a limited <br /> <br />period of time different from the criteria, <br /> <br />The Senate Report in the 90th Congress f First Session, Senate <br /> <br />Report No. 408 to accompany S. 1004 ,at pages 62 through 6S [attached <br /> <br />hereto as Appendix 4], was, for all practical purposes I the same as the <br /> <br />language in the House Report above cited for the 89th Congress. The <br /> <br />Conference report, House Report 1861, 90th Congress, 2d Session, did <br /> <br />not add any information which would indicate that the Secretary was intended <br /> <br />6 <br />
