<br />f:# <br /> <br />to satisfy Article III (c) [Mexican Treaty burden] if a deficiency is found <br /> <br />to be chargeable to the Upper Division. Priority No.2 is granted to <br /> <br />releases from Lake Powell so that the Upper Division States will meet <br /> <br />those operations of the Colorado River Compact set forth in Article In (d) <br /> <br />[75 maf in 10 years]. Priority No. 3 is a storage priority and requires <br /> <br />that there be maintained in Lake Powell sufficient water to insure that <br /> <br />the Upper Division States can make priority releases (1) and (2) without <br /> <br />impairing Upper Division annual consumptive uses. This is to be a <br /> <br />computed quantity and will change with time. <br /> <br /> <br />To priority No. 3 there is add,i proviso. This proviso authorizes <br /> <br />the release of water from Lake Powell which is not required to be stored <br /> <br />to assure the Upper Basin uses and deliveries under priorities (1) and (2). <br /> <br />But this Lake Powell release is not an absolute release and is conditioned <br /> <br />upon the occurrence of certain events I namely: <br /> <br />First, releases can be made of this I for want of a better term, <br /> <br />"excess water" if the Lower Division States can reasonably apply such <br /> <br />water to uses which are specified in Article III (e) of the Colorado River <br /> <br />Compact I namelY--domestic and agriculture uses. This particular release <br /> <br />is further conditioned by the requirement that these releases cannot be <br /> <br />made "when the active storage in Lake Powell is less than the active <br /> <br />storage in Lake Mead." The second condition which authorizes a release <br /> <br />of "excess water" is that releases are to be made to maintain the active <br /> <br />storage in Lake Mead equal to the active storage in Lake Powe 11.
