ongoing reco'\rery program approved by the federal gOvumnent to offset
jeopardy to a listed species or adverse modification to critical habitat caused

(III) The board has determined that: the acqmsition of conditional
wate! rights will pro~de benefits to the reCOver) program that would not
be available through iuitial appropriation by thc bom-d, and

(IV) A change of such conditional \~ ater rights is subject to all other
p!ovisions of Colorado la~".
