the proposed statutory additions or changes. The Board approved the motion with the <br />following amendments: <br />(1) That the Boazd direct Staff to take the language developed at this Board meeting in <br />concept, incorporate it into the Projects Bill; <br />(2) The Board is able to review the proposed language before it goes to the Legislatt.cre; <br />(3) Staff is to address the language, "used in limited circumstances, but not limited". <br />(4) The legislation will require the Boazd to develop guidelines and criteria that will be <br />used to administer the acquisition program prior to any expenditures of this funding; and <br />(5) That future appropriations far acquisition be sufficient to refresh the fi:md annually <br />to a balance of 1 million. The motion was approved (9-1). <br />8c. CWCB Legislative Priorities and Recommendations -Tamarisk Control Grant Program <br />Action: After consultation with the Executive Director of the Department of Natural Resources, <br />Staff recommends that the following provision be included in the 2008 Projects Bill: <br />SECTION 28. Tamarisk control cost-sharing grant program -appropriation. (1) In <br />ut of an un-allocated <br />addition to an other a ro riation, there is hereby appropriated, o y <br />Y PP P <br />moneys in the Severance Tax Trust Fund Operational account not otherwise appropriated, <br />to the Department of Natural Resources, for allocafion into the Colorado Water <br />Conservation Boazd construction fund, for the fiscal yeaz beginning July 1, 2008, the: sum <br />of up to one million dollars ($1,000,000), or so much thereof as may be necessary, fear the <br />Board to fund a tamarisk control cost-sharing grant program; and (2) The money's <br />appropriated in subsection (1) of this section shall remain available for the designated <br />purposes until the project in completed. There was a motion made by Geoff.Blakeslee <br />and secondex by John Rexlifer to approve Staff recommendation. All voting members <br />were present. The motion was approved unanimously (10-0}. <br />8d. CWCB Legislative Priorities and Recommendations -Water Conservation Guideliine and Plan <br />Clarifications <br />Action: A motion was made by Eric Wilkinson and seconded by Harris Sherman to approve Staff <br />recommendation regazding the :inclusion of statutory changes in the 2008 (:onstruction <br />Fund Projects Bill to achieve the Boazd's intent. The Staff has the authori:~ation to work <br />with the Executive Director's Office, the Governor's Offiice, and members of the General <br />Assembly regarding the specific language. The Staff shall have the authorization to <br />recommend the deletion of such statutory changes from the bill if their inclusion <br />endangers the bill's final passage. The Staff shall keep the Board members informed <br />regarding the progress of discussions regarding the proposed statutory change. The <br />Boazd requested that the following amendments be included in the motion: <br />Statute 37-60-126(4) C.R.S. is amended to read, (4} A Plan developed by a covered entity <br />°, pursuant to subsection (2) of this section shall, at a minimum, include the full evaluation <br />of the following plan elements..,The motion was approved unanimously (iQ-0). <br />8e. CWCB Legislative Priorities and Recommendations - Instream Flow Lessor Protection <br />Action: The CWCB Staff is recommending statutory revisions to protect water rights owners who <br />lease or otherwise contractually allow the CWCB to use all or a portion of their water <br />rights as instream flows to preserve or improve the natural environment to a reasonable <br />degree. These statutory revisions would apply to long term loans or leases of water and <br />`, would provide the same protection that HB 07-1012 provided to water rights owners who <br />temporarily loan or lease their water rights to the CWCB under section 37-83-102(2), <br />C.R.S. A motion was made by Eric Wilkinson and seconded by Harris Sherman to <br />approve Staff's above recommendation with the proposed amendments: that guidelines <br />and criteria be developed by CWCB to govern the administration of this program; that the <br />amendments to the proposed bill, as proposed in the amended Boazd handout, be <br />incorporated into the proposed legislation; and that the reference to a water right that may <br />
