Trout Creek Fishery Channel No. 4, with a point of diversion on Trout <br />Creek in the NW1/4 SEl/4, Section 25, T40N, R2W of the N.M.P.M., at a point 2320 feet from the <br />south section line and 2540 feet from the east section line; with alternate points of diversion at <br />the points of diversion for the Trout Creek Fishery Channel No. 2 and the Trout Creek Fishery <br />Channel No. 3. <br />e. Trout Creek Fishery Channel No. 5, with a point of diversion on Trout <br />Creek in the SW1/4 NEl/4, Section 25, T40N, R2W of the N.M.P.M., at a point 2090 feet from the <br />north section line and 1990 feet from the east section line. <br />Each of the Trout Creek Structures will include an exca~~ated inlet and return channel, with one <br />or more ponds located along the course of the channel. The Trout Creek Structures will di~~ert <br />surface water from Trout Creek, at a rate of up to 1 c.£s, in series (not additi~~e), subject to the <br />limitations in paragraph 6, below, and may also intercept ground water tributary to Trout Creek. <br />Water diverted into the Trout Creek Structures will be used for recreation, piscatorial, and fish <br />and wildlife habitat purposes. <br />2. In Consolidated Case Nos. 04CW9 and 99CW34, Nearburg has applied for <br />approval of a water supply plan for the Trout Creek Structures and other structures, which <br />includes adjudication of water rights for the Structures, a change of water rights, and a plan for <br />augmentation, including appropriative rights of exchange, to replace out-of-priority depletions <br />associated with the Trout Creek Structures and other structures. <br />3. The CWCB has adjudicated a minimum instream flow water rights ("ISF") on <br />Trout Creek in Case No. 84CW166, Water Di~~ision No. 3, for 35 c.f.s. from May 1st through <br />September 30th, and 15 c.f.s. from October 1St through April 30th, with an appropriation date of <br />August 16, 1982. The Trout Creek ISF reach extends through Nearburg's Trout Creek Ranch, <br />and diversions to the Trout Creek Structures will occur within this ISF reach. <br />4. In 1998 and 2001, Nearburg restored to a natural condition o~~er 8500 linear feet <br />of the Trout Creek stream channel through the Trout Creek Ranch. Prior to these restoration <br />efforts, Trout Creek through the Trout Creek Ranch was typically a wide, shallow riffle stream <br />with little or no holding capacity for fish. The restoration efforts in~~ol~~ed, without limitation, <br />bank re~~etment and re~~egetation, installation of 105 instream rock boulder structures to (among <br />other things) create pools for habitat (the ``Stream Habitat Improvement Structures"), and <br />reshaping and deepening of the channel to pro~~ide a lower width-depth ratio. The restoration has <br />substantially improved the hydraulic conditions of the stream and increased the ability of Trout <br />Creek to protect aquatic biota and the natural environment with lower flows. <br />5. The Trout Creek Structures will be constructed as off-channel ponds, together <br />with associated open channels, fill ditches and return facilities to Trout Creek. These Structures <br />will be constructed specifically to impro~~e the Trout Creek fishery by pro~~iding additional depth <br />
