1 Section 15. Oak creek flood control mitigation feasibility study
2 -appropriation. (1) In addition to any other appropriation, there is
3 hereby appropriated, out of any moneys in the Colorado water
4 conservation board construction fund not otherwise appropriated, to the
5 Colorado water conservation board, for the fiscal year beginning July 1,
6 2005, the sum of one hundred sixty-seven thousarid dollars ($167,000),
7 or so much thereof as may be necessary, for the board to participate with
8 the city of Florence, Colorado, in the Oak creek reser~o~ir FLOOD CONTI~:oL
9 MITIGATION feasibility study to be prepared by the United States Army
10 corps of engineers. o~

12 SECTION 25. Article 60 of title 37, Colorado Revised Statutes,
13 is amended BY THE ADDITION OF A NEW SECTION to read:
14 37-60-120.1. Chatfield reservoir reallocation project -.
15 authority -repeal. (1) IN ORDER TO PROMOTE THE GENERAL WELFARE
16 AND SAFETY OF THE CITIZENS OF THIS STATE AND UTILIZE REALLOCATED
17 STORAGE SPACE AVAILABLE IN THE FEDERAL FLOOD CONTROL PROJECT
18 KNOWN AS C~IATFIELD RESERVOIR, THE BOARD HAS UNDERTAKEN THE
19 CHATFIELD RESERVOIR REALLOCATION PROJECT, REFERRED TO IN THIS
20 SECTION AS THE "PROJECT", INCOORDINATION AND COOPERATION WITH. A
21 LOCAL COALITION AND WITH PARTICIPANTS WHO HAVE EXECUTED LETTERS
22 OF COMMITMENT WITH THE BOARD. THE IMPLEMENTATION OF THE
23 PROJECT WILL RESULT IN BENEFITS TO SOUTH PLATTE RIVER WATER USEILS
24 AND THE DOWNSTREAM ENVIRONMENT WITHOUT ADVERSELY IMPACTING
25 OTHER RIVER BASINS. THE IMPLEMENTATION OF THE PROJECT WILL
26 REQUIRE THE BOARD TO CONTRACT WITH THE UNITED STATES ARMY
27 CORPS OF ENGINEERS, REFERRED TO IN THIS SECTION AS THE "CORPS", TO
