Application Summary
This is an application for conditional surface water and ground water rights, approval of a plan
for augmentation including exchange, and conditional rights of exchange for the Town of
Minturn. The proposed uses are aesthetic, piscatorial, recreational, augmentation and exchange,
domestic, irrigation, commercial, industrial, and municipal.
1. The Applicant seeks a conditional surface water right for Minturn Eagle River Pumpback
for 12 cfs with an appropriation date of 12/19/2007. The Applicant seeks to divert the
water from any one or combination of the Pumpback alternate points of diversion listed in
the application. The application states that a portion of the Applicant's diversion for non-
consumptive uses may be used to maintain the Colorado Water Conservation Board's
instream flow water rights on Cross Creek and the Eagle River.
2. The Applicant seeks a conditional surface water right for Minturn Cross Creek Diversion
for 12 cfs from any one or combination of various alternate points of diversion listed in
the application with an appropriation date of 12/19/2007 for the same uses described
above.
3. The Applicant seeks an enlargement of ground water rights for Minturn Well No. 3 and
Well No. 4 for 225 gpm each with an appropriation date of 12/19/2007 for the same uses
described above.
4. The Applicant seeks approval of a plan for augmentation, including exchange to replace
out-of-priority depletions associated with its many diversions.
5. The Applicant seeks conditional rights of exchange, including wastewater effluent
exchange, for various rates and exchanges reaches with an appropriation date of
12/19/2007.
