Consent Agenda Item l.h <br />Case No. 4-07CW203: Application of Skyland Metropolitan District <br />Application Summary <br />This is an application for ground water rights, appro~~al of a plan for augmentation and exchange in <br />Gunnison County south of Crested Butte. The Applicant seeks the following: <br />1. Conditional ground water rights for fi~~e wells, Skyland East River Well Nos. 1-5, for 466 <br />acre feet per year with an appropriation date of March 31, 2005 for augmentation, <br />replacement, exchange and storage, as well as domestic, household, mechanical, <br />commercial, manufacturing, industrial, generation of power, fire protection, street <br />sprinkling, watering of parks, lawns, trees, gardens, golf courses and other grounds, the <br />maintaining of adequate municipal reser~~es, and the adjustment and regulation of water in <br />and bet~-een the ~~arious units and features of the Skyland district's water system. The water <br />will be used within the boundaries of the Skyland district, as such boundaries may be <br />expanded in the future within Gunnison County. <br />2. Appropriative right of exchange, "Skyland Pumpback Exchange," of East Ri~~er Treatment <br />Plant effluent (foreign to this reach of the East Ri~~er) via wells with an appropriation date of <br />March 31, 2005 for the same uses as the wells. <br />3. Appro~~al of a plan for augmentation to pro~~ide replacement water for out of priority <br />depletions for the new groundwater rights. The sources of augmentation include Lake Grant <br />Enlargement with an appropriation date of Sept 21, 1992, and the foreign water treatment <br />plan effluent. <br />CWCB Appropriation <br />The CWCB holds the following instream flow water rights that could be injured by this application: <br />CWCB Stream/Lake Amount Approp. Lacy, Jr, Lacy & Dow, LLC and Verzuh Ranch, Inc. also filed a Statement of Opposition <br />to this application. <br />
