Consent Agenda Item l.c <br />Case No. 5-07CW211: Application of Board of County Commissioners for Summit County <br />Application Summary <br />This is an application for change of water right and for finding of reasonable diligence for the water <br />rights decreed to the Blumenhein Well Nos. 1 and 2, originally decreed on March 17, 1973 in Case <br />No. W-1204 in Water Court Division 5. The Applicant also seeks approval to add County Well <br />Nos. 1 and 2, which are existing unpermitted structures tributary to Miners Creek and Dillon <br />Reser~~oir, as alternate points of diversion for the water rights decreed for the Blumenhein Well <br />Nos. 1 and 2. Additionally, the Applicant requests appro~~al to alternately divert the water rights <br />decreed for the Blumenhein Well Nos. 1 and 2, individually or in combination, through additional <br />and supplemental wells to be constructed within the 130+acre County Commons PUD property. <br />CWCB Appropriation <br />The CWCB holds the following instream flow water right that could be injured by this application: <br />CWCB Stream/Lake Amount Approp. Watershed County <br />Case No. (cfs) Date <br />5-85CW649 Miners Creek 1.5 11/8/85 Blue River Summit <br />Potential for Injury <br />The Applicant's proposed change of points of di~~ersion may alter patterns and locations of <br />depletions on Miners Creek, which could injure the Board's instream flow water right on Miners <br />Creek . <br />Other Objectors <br />The Town of Frisco also filed a Statement of Opposition to this application. <br />
