<br />e <br /> <br />e <br /> <br />standards and procedures for consumptive use decree accounting for Priorities I, 2, and 3b which utilize, at <br />MWD's discretion, either a 25-year running average or an actual annual consumptive use. The <br />development of the standards and procedures for running average accounting will be done in consultation <br />with the other Basin states. <br /> <br />Inadvertent overruns occur when a consumptive water use entitlement for that year, as modified by the Key <br />Terms, is exceeded. The delays in obtaining decree accounting data and good water management requires <br />flexibility in annual year deliveries. The Key Terms call for cumulative inadvertent overrun accounts of <br />310,000 acre-feet, 46,800 acre-feet, and 100,000 acre-feet for lID, CVWD, and MWD, respectively. <br />Overruns within these limits must be repaid by reductions in diversions below a district's entitlement over a <br />five-year period in annual amounts of at least 20% per year, starting in the fIrst full year after an overrun is <br />reported by the Bureau. Any overruns in excess of a district's allowed account mu~t be repaid within the <br />first full calendar year after the excess is reported by the Bureau. Overrun paybacks would be forgiven in <br />the event of flood control spills or anticipated flood control releases and overrun paybacks would be tolled, <br />but not prohibited, during surplus flow conditions on the Colorado River. Development of inadvertent <br />overrun procedures and accounts for all three lower Basin states will be considered in a formal public <br />process conducted by the Bureau of Reclamation. <br /> <br />The Department of the Interior will appoint an independent panel to review and provide recommendations <br />in connection with the determination of the consumptive use of water on the Yuma Island and whether such <br />use should be charged to Priority 2. <br /> <br />The Key Terms also provide that the Bureau will determine that the interim period under the Colorado <br />River Basin Salinity Control Act has not ended so long as IID and MWD submit annual estimates of water <br />diversions to the Bureau with the modifier" to the extent Colorado River water is available to lID and <br />MWD under each of its entitlements and the Quantification Settlement water budget components." The <br />interim period refers to the period when conserved water resulting from the lining of the first 49 miles of <br />the Coachella Canal is being used to offset the bypass of Well ton-Mohawk drainage to the Santa Clara <br />Slough for the purpose of meeting the salinity control objectives of Minute No. 242 of the International <br />Boundary and Water Commission. The Bureau will consult with the other Basin states on this matter. <br /> <br />Conditions Precedent. Conditions precedent defme the items that must be completed before final approval <br />of the Quantification Settlement. Anticipated environmental reviews include specific reviews for new <br />projects, Endangered Species Act (ESA) Section 10 "No Surprises" 50-year compliance assurance and <br />associated Habitat Conservation Plans (HCP) for the Imperial and Coachella Valleys, and the Lower <br />Colorado River Multi-Species Conservation Program and its HCP. The first two of these are identified as <br />conditions precedent. Specific conditions precedent include: <br /> <br />· Preparation of appropriate legal documents, agreements, and arrangements <br />· Necessary public and environmental reviews <br />· Implementation of Revised Surplus Criteria (Lake Mead Interim Surplus Criteria) <br />. Implementation of inadvertent overrun program <br />· Certain decree accounting procedures <br />. PVID's agreements <br />· SLR Indian Water Rights Settlement water supply arrangements <br />· IID / CVWD Salton Sea flood damages liability agreement <br />. Water budget arrangements, agreements, and approvals <br />. State and federal approvals <br /> <br />There is a need to obtain agreements with Palo Verde Irrigation District regarding its water use and <br />potential cooperative water supply programs. <br /> <br />Interagency Comity, Special Provisions. To help bring resolve to long-standing differences between the <br />districts and to build greater interagency cooperation, special provisions (Accommodations and Settlement) <br /> <br />6 <br />
