<br />Governance Structure <br /> <br />A governance structure headed by the State with supporting contributions by water users <br />or others through contracts and/or advisory groups will be necessary to fulfill the State's <br />obligations under the Proposed Program and the State's responsibility for effective water <br />management and administration. To fulfill these responsibilities, a functional <br />organization that is responsible to develop, operate, and maintain the physical elements of <br />the Tamarack Plan must be created. The many details of the Tamarack Plan must be <br />defined, agreements signed, and duties and responsibilities assigned. An overall strategy <br />that provides the leadership, support, and guidance to accomplish Colorado's <br />commitment must also be completed. The proposed governance structure and operational <br />arrangements outlined below will facilitate the completion ofthese important tasks so <br />that the State's obligations to the Proposed Program can be met using effective and <br />efficient water management and administration principles. An attached spreadsheet <br />illustrates these organizational relationships and programmatic responsibilities. <br /> <br />In the proposed governance structure, the Department of Natural Resources ("DNR") <br />would continue to represent the State's interests and appoint the Colorado representative <br />to the Governance Committee. Additionally, DNR would direct the state effort, <br />including implementation of the Tamarack Plan. DNR would establish the Colorado <br />Platte Operations Group (CPOG) comprised of staff from the Division of Wildlife <br />(DOW), Colorado Water Conservation Board (CWCB), and the Division of Water <br />Resources (SEO) along with representatives from the South Platte water users and well <br />augmentation entities. CPOG's task is to cooperatively resolve the numerous operations, <br />maintenance, planning, design and construction issues associated with implementing the <br />Tamarack Plan. It is CPOG's responsibility to reach a consensus on all issues related to <br />implementation ofthe Tamarack Plan, with the exception of those Tamarack Plan <br />projects on SW As. DOW will be the final authority on any decision related to multiple <br />uses of a SW A. Nonetheless, DOW agrees to make a good faith effort to develop a <br />consensus on resolution of the issue related to SW A within the CPOG before exercising <br />its final authority. <br /> <br />Facility and Operational Planning and Management <br /> <br />Once the governance structure is operational, the actual design, development, and <br />operation of the Tamarack Plan can go forward. As proposed, these tasks will be planned <br />and developed under leadership of DNR for non-SW A and under the leadership of DOW <br />on SW As. The CPOG will assist DNR and DOW with these tasks. It is anticipated that <br />actual construction and operation of the Tamarack Plan will be accomplished through <br />contracts or other third party arrangements. <br /> <br />CPOG would provide input, expertise, and guidance to the DNR, SEO, and DOW in the <br />following areas: <br /> <br />Proj ect design and development <br />Proj ect construction <br /> <br />Tamarack OM&R plan: version 01/01/2002 <br /> <br />2 <br />
