Durango RICD

It has not been demonstrated that these proposed structures will be durable or that they
will reliably control the flow over a reasonable period of time.

Basis of Opinion

~

The structures' durability, including their ability to withstand high fl~w~has not been
demonstrated. Structural stability and hydraulic analy~including up1iIt, piping, and seepag.j
were not provided. It was not clear how much water will flow beneath the structures
(uncontrolled flow) or for how long the structures will reliably control the surface flow.
Therefore, the ability of the in-channel structures to reliably control all of the flow has not been
demonstrated.

Legal Basis
Policy Manual:
Policy Manual:
SB 216:
SB 216:
SB 216:
SB 216:
SB 216:

Supreme Court Decision:

Adverse Impacts and Durability
Hydraulic Engineering Definition of Control
Appropriate Reach of the Stream Required for the Intended Use.
(10.3) Capture and Control
Access for Recreational In-Channel Use.
Section 2, 37-92-103, (4) Beneficial Use
Section 2, 37-92-103,(10.3), Recreational In-channel Diversion
Means...
Minimum Flow Rate

Opinion #9.

It has not been demonstrated that these in-channel structures control throughout the
requested flow range.

Basis of Opinion J::..l\~~'
A hydraulic co~;~ Itn.own as critical depth should occur near the entrance o{ each structure.
This conditiOI1;~i;~~~~Ydraulic control of the river flow (above the structure's invert) at that
particular flow rate arId at that time. However, there are no documents or analysis that
adequately substantiate that these in-channel structures will create this control over the requested
range ofRICD flows. Therefore, "control" of the requested flow rates has not been
demonstrated.

Legal Basis
Policy Manual:
SB 216:

Hydraulic Engineering Definition of Control
(10.3) Capture and Control
