6. The changes to Rule 7(b) are based on the need to analyze the impacts associated
with construction and design of RICD structurcs. These lactors. in particular. are based
on Hoodplain engineering: engineering principles. hydraulics~ boating principles and
existing laws or rules. Issucs such as the slope, length. width and depth of the stream
reach, the water vclocity and the effects on the 1l00dplain all relate to whether the
applicant chosc an appropriate reach of stream and must be considered in analyzing that
lactor. The changes to Rule 7(e) arc premised upon experiences gained by the board to
date in the adjudication ofthc RICD cases.

7. It is important to note that the definition of RICD must be applied whenever that
term appears in rule or statute. Although these rules may use abbreviated or modified
versions of this definition for brevity or clarity, this will not mean that the definition has
changed in any way Irom the full definition.
