Water Supply Reserve Account - Grant Application Form Form Revised May 2007 Article 37-75 will not be applied to injure water rights or to affect the rights of persons to use water. The SMP is intended to evaluate water needs within the context of Colorado water law and Federal regulations governing water development. The goal of Phase 3 of the SMP is to perform stream assessments and analysis for restoration opportunities and the development of a master plan for implementing restoration projects along the Fraser and the Upper Colorado River. This phase will also include continued coordination on development of alternative flow operations that might help achieve recommended flows. developed in Phase 2. Grand County intends to use the SMP to work with water providers to identify opportunities for operational changes which could enhance stream health. Neither of the proposed activities violates any of the rights protections outlined in section 37-75- 102 of the Colorado Revised Statutes. 3. The water activity underwent an evaluation and approval process and was approved by the Basin Roundtable (BRT) and the application includes a description of the results of the BRTs evaluation and approval of the activity. At a minimum, the description must include the level of agreement reached by the roundtable, including any minority opinion( s) if there was not general agreement for the activity. The description must also include reasons why general agreement was not reached (if it was not), including who opposed the activity and why they opposed it. Note- If this information is included in the letter from the roundtable chair simply reference that letter. This section will be completed after the BRT's evaluation is complete. 4. The water activity meets the provisions of Section 37-75-104(2), Colorado Revised Statutes. The requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines. The SMP is exactly in keeping with section 37-75-104(2)(c) of the Colorado Revised Statutes in that it is designed to develop the Upper Colorado River Basin nonconsumptive portion of the water supply needs assessment called for in the statute. Once completed the SMP will have the potential to serve as a template for the type of guidance document that can be used in other watersheds and particularly downstream in the Colorado River Basin. 5
