<br />Water Supply Reserve Account - Grant Application Form <br />Form Revised May 2007 <br /> <br />Article 37-75 will not be applied to injure water rights or to affect the rights of persons to use water. The SMP is <br />intended to evaluate water needs within the context of Colorado water law and Federal regulations governing <br />water development. The goal of Phase 3 of the SMP is to perform stream assessments and analysis for restoration <br />opportunities and the development of a master plan for implementing restoration projects along the Fraser and <br />the Upper Colorado River. This phase will also include continued coordination on development of alternative <br />flow operations that might help achieve recommended flows. developed in Phase 2. Grand County intends to use <br />the SMP to work with water providers to identify opportunities for operational changes which could enhance <br />stream health. Neither of the proposed activities violates any of the rights protections outlined in section 37-75- <br />102 of the Colorado Revised Statutes. <br /> <br />3. The water activity underwent an evaluation and approval process and was approved by the Basin <br />Roundtable (BRT) and the application includes a description of the results of the BRTs evaluation <br />and approval of the activity. At a minimum, the description must include the level of agreement <br />reached by the roundtable, including any minority opinion( s) if there was not general agreement for <br />the activity. The description must also include reasons why general agreement was not reached (if it <br />was not), including who opposed the activity and why they opposed it. Note- If this information is <br />included in the letter from the roundtable chair simply reference that letter. <br /> <br />This section will be completed after the BRT's evaluation is complete. <br /> <br />4. The water activity meets the provisions of Section 37-75-104(2), Colorado Revised Statutes. The <br />requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines. <br /> <br />The SMP is exactly in keeping with section 37-75-104(2)(c) of the Colorado Revised Statutes in that it is designed <br />to develop the Upper Colorado River Basin nonconsumptive portion of the water supply needs assessment called for <br />in the statute. Once completed the SMP will have the potential to serve as a template for the type of guidance <br />document that can be used in other watersheds and particularly downstream in the Colorado River Basin. <br /> <br />5 <br />
