B rings up the question of legality as A rticle XVI of the State <br /> <br />Constitution states: lIThe right to divert the unappropriated waters <br /> <br />of any natural stream shall never be denied. \I <br /> <br />Significance - recognizes protection of the environment, fish and wildlife <br /> <br />as a beneficial use or that appropriations can be made in the name of <br /> <br />the people or in a sense for the gal eral public. <br /> <br />Importance - grants the right to compete for unappropriated waters for <br /> <br />environmental and recreational purposes or to prevent further de- <br /> <br />~vatering of natural streams and tends to prevent future trans -mountain <br /> <br />diversions where water rights have not yet been acquired.
