R. No. 1014, by Representatives Edmonds and Lamm, <br /> <br />H'HEREAS, The Senate of the Fo-rty-ninth General <br />Assembly, at its first regular session thereof, has passed and <br />transmitted to the House or Representatives Senate Bill <br />:\0,97 entitled "A BILL FOR AN ACT CONCERNING THE <br />APPROPRIATION OF \VATER. AND PROVIDING FOR <br />THE APPROPRIATION OF \VA'TER BY THE STATE OF <br />COLORADO TO PROTECT THE NATURAL ENVIRON- <br />?tIE NT," , a copy of which is attached hereto; and <br /> <br />lVHEREAS, Senate Bill No. 97 has been duly passed by <br />the House of Representatives on second reading; and <br /> <br />H'HEREAS, The House of Representatives ,,,ill probably <br />pass said bill upon third and final reading if said bill be <br />deemed constitutional; and <br /> <br />WHEREAS, The Attorney General has heretofore rend- <br />ered his opinion on the - constitutional questions herein in- <br />\'oh.ed; and <br /> <br />WHEREAS, The House of Representatives still enter- <br />tains doubts concerning the constitutionality of said bill; <br />and <br /> <br />WHEREAS, Section 1 of said bill provides, in part. that <br />the term "appropl'iatiCn" means the application of a certain <br />portion of the \yaters of the state to a beneficial use, and re- <br />~oYes the statutory requirement or a diversion of such por- <br />tlon; and <br /> <br />WHEREAS. Section 1 of said bill provides, in part, that <br />the beneficial u~e of water includes the impoundment of water <br />for recreational purposes, including fishery or wildlife, for <br />the benefit and enjoyrnent of present and future generations, <br />and the appropriation by the state of Colorado of such mini- <br />mUm flows between specific points or levels for and on natural <br />streams and lakes as are required to preserve the natural <br />eUYironment to a reasonable degree; and <br /> <br />WHEREAS, Section 2 of said bill provides in part that <br />the state of Colorado is vested with the authority to appropri- <br /> <br />~ <br /> <br />-rfi PE 2- <br />SlOE I <br />.L{(X) - 560 <br />
