, <br />� <br />� <br />, <br />In 2001 the Colorado Division of Water Resources, Divisian 5, filed the decennial abandonment list <br />with the water clerk claiming abandonment of a portion of the absolute water rights decreed to Bull <br />Creek Reservoir No. 4. In 1984 a filling restriction was placed on the reservoir because the crest <br />width of the dam did not meet current State Engineer's guidelines and rules for minimum crest <br />width. This effectively caused a reduction in allowable storage, which predicated the abandonment <br />proceedings. Lastly, visual inspections by the Dam Safety Engineer in 2003, 2004, and 2005 <br />raised questions of a possible high phreatic level in the embankment, which resulted in a further <br />filling restriction being ordered in 2005. <br />The Reservoir Company responded in a timely fashion to the abandonment proceedings. This has <br />, resulted in a"Stipulation and Agreement" ("Agreement," Appendix B) befinreen the Colorado <br />Attomey Generals Office and the Bul� Creek Reservoir, Canal, and Power Company. This was <br />, signed October 31, 2003, and has been amended several times since to extend and clarify the <br />schedule of work. The Agreement is currently being revised to reflect a 2007 construction season. <br />PROJECT SPONSOR <br />The Bull Creek Resen�oir, Canal, and Power Company is a non-profit corporation registered in <br />the State of Colorado. There are 19 shareholders aiid 500 shares of stock. The Reservoir <br />Company has the power to set annual assessments to be paid by the shareholders, the power <br />to cut off water deliveries to shareholders that fail to pay their assessments, and the power to <br />offer stock for sale to pay back assessments. <br />The Company adjusts annual assessments to reflect what needs to be paid. They do not collect <br />monies in advance for future expenditures. <br />PROJECT SERVICE ,AREA AND FACILITIES <br />The Reservoir Compa�ny provides irrigation water to approximately 800 acres in Mesa County. <br />The water stored by �he project is the primary source of mid- to late summer irrigation water. <br />Figure 1 shows the location of the reservoirs and the s�ervice area.
