"Waters imported into the Arb.nsas River Basin" or .imported <br />waters. mean waters brought into the Arb.nsas River Basin from other river basins. <br /> <br />m. .Well user. means the owner of a water right to diven tributary <br />ground water in the Arb.nsas River Basin in Colorado and any person having the right to <br />use such a water right owned by another, including successors, lessees, contractees, or <br />assigns. <br /> <br />; <br /> <br />, n. Any other term used in these Rules that is defined in Article 90 or <br />92, IS C.R.S. , or in Article m of lhe Arkansas River Compact, is used with the <br />meaning given therein. <br /> <br />Rule 3. Ground Water J?iversions and De,pletions Affectine Usable Stateline Flow. <br /> <br />Rule 3.1. Ground Water Diversions for Irrigation Use by Post-compact Ground <br />Water Rights Affecting Usable Statcline Flow. On or after Aprill, 1996, all diversions <br />of tributary ground water for irrigation use from the Valley Fill Aquifer and surfi.cia! <br />aquifers along the Arb.nsas River between Pueblo and ~ Statelinc by weU users having <br />water rights with a priority of, or junior to. December 14, 1948, shall be totally discon- <br />tinued unless depletions (0 usable Stateline flow caused. by such diversions are replaced in <br />accordance with a plan approved by lhe state and division engineers pursuant to these <br />Rules. <br /> <br />. <br /> <br />Rule 3.2. Ground Water Diversions for Irrigation Use By Decreed Pre-Compact <br />Ground Water Rights Affecting Usable Stateline Flow. On or after Aprill, 1996, all <br />diversions of tributary ground water for inigation use from the Valley Fill Aquifer and <br />surficial aquifers along the Arbnsas River between Pueblo and the Stateline by well <br />users having decreed pre-compact ground water rights shall be limited to an aggregate <br />total of 15,000 acre-feet per year (November I through October 31) unless depletions to <br />usable Stateline flow caused by diversions of amounts grc..ater than 15,000 acre-feet per <br />year are replaced in accordance with a plan approved by the state and division engineers <br />pursuant to these Rules. <br /> <br />. <br /> <br />Rule 3.3. Pre-compact Pumpine Allowances. For the purpose of implementing <br />Rule 3.2, each decreed pre-compaa ground water right for irrigation use from the Valley <br />Fill Aquifer and surficial aquifers along the Arkansas River between Pueblo and the <br />Stateline shall be allocated an annual pre-compact pumping allowance for the purpose of <br />determining depletions to usable Stateline flow. The anntlal pre-compact pumping <br />allowance for each decreed pre-compact ground water right for irrigation use shall be <br />determined by multiplying 15,000 acre-feet times the decreed capacity of that ground <br />water right, weighted depending on whether the ground water right is used as a supple- <br />mental or as a sole source supply, and dividing by the total weighted decreed capacity of <br />all decreed pre-compacl ground water rights for irrigation use. Ground water rights used <br />as a supplemental supply shall be given a weight of sixty percent (60%) and ground water <br />rights used as a sole source supply shall be given a weight of one-hundred percent <br /> <br />3 <br /> <br />
