<br />I <br /> <br />I <br /> <br />(f) The committee shall hear all complaints <br />involving alleged injustice, wrongful discharge, and <br />other violations of the rules and regulations of the <br />committee and shall hear all appeals from decisions <br />of the board on disciplinary actions pursuant to <br />paragraph (e) of this subsection (2). All su~h hearings <br />shall be conducted in~e same manner, insofar as <br />possible, as provided in section 24-4-105, C.R.S. The <br />decision of the committee shall be final and shall not <br />be set aside except by the committee or by a court of <br />competent jurisdiction. Judicial review of any <br />decision of the committee may be had in the same <br />manner as prescribed in section 24-4-106, C.R.S. <br />(g) The board, if requested by the <br />committee, may contract with any municipal or state <br />agency for the pwpose ,of conducting examinations <br />for original appointment or for promotion, or for any <br />other purpose in conn~tion with the selection or <br />administration of personnel. <br />(h) The fIrefighters of any fire protection <br />district in good standing at the time of the <br />establishment of said civil service system shall <br />continue in their employment and rank, shall be <br />automatically included in the civil service system, <br />and shall be promoted or discharged in acccrdance <br />with the provisions of the civil service rules and <br />regulations; except that the office of fire chief shall <br />be excluded from such civil service system. The <br />board shall make provision for tenure of the fire <br />chief, and the committee shall implement the same by <br />appropriate rules and regulations. <br />(i) Any fire protection district which has <br />established a system of civil service for its paid <br />employees pursuant to this section shall not terminate <br />the system unless the question of termination is <br />submitted at an election. The election shall be <br />conducted pursuant to the provisions of articles 1 to <br />13 of tide 1, c.R.S. <br />(j) The board shall appropriate annually, by <br />resolution, to the committee sufficient funds to <br />administer the provisions of this subsection (2). <br />(k) If any county assumes countywide <br />responsibility for fire protection or any board of <br />county commissioners becomes the board of a fIre <br />protection district and ~dopts a countywide merit, <br />civil service, or career service system, any civil <br />service system established under the provision of this <br />subsection (2) shall be dissolved and merged with <br />such countywide syste~, including all employees' <br />benefits, rights, liabilities, and duties accrued or <br />incurred under this subsection (2), and the same shall <br />be continued following such merger. <br />(3) (a) The chief of the fIre department in <br />each fire protection district in the state of Colorado, <br />by virtue of such office so held by him, shall have <br />authority over the superVision of all fIres within the <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I' <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />district, except as otherwise provided by law, subject <br />to the duties and obligations imposed by this <br />subsection (3), and shall be vested with such other <br />express authority as is contained in this subsection <br />(3), including commanding the fIre department of <br />such district. <br />(b) The chief of the fIre department in each <br />fIre protection district shall: <br />(I) Enforce all laws of this state and <br />ordinances and resolutions of the appropriate political <br />subdivisions relating to the prevention of fires and <br />the suppression of arson; <br />(II) (A) Inspect, or cause to be inspected by <br />members or officers of his department, as often as he <br />shall deem necessary, all buildings, premises, and <br />public places, except the interior of any private <br />dwelling, for the purpose of ascertaining and causing <br />.to be corrected any condition liable to cause fire or <br />for the pwpose of obtaining information relative to <br />the violation of the various provisions of this <br />subsection (3). Any individual conducting such <br />inspection shall carry on his person properly <br />authorized fire department identification which shall <br />be shown, on request, to the owner, lessee, agent, or <br />occupant of any structure prior to the inspection of <br />the same. <br />(B) The chief of any such fIre department or <br />fire department members designated by the chief <br />have the authority to enter into all structures and <br />upon all premises within their respective jurisdictions <br />at reasonable times during business hours or such <br />times as such structures or premises are open for the <br />purpose of examination in conformity with the duties <br />imposed by this subsection (3), and it is unlawful for <br />any person to interfere with the chief of any such fire <br />department, or any member of such fire department <br />designated by the chief to conduct an inspection, in <br />the discharge of his ~uties or to hi.iJ.der or prevent him <br />from entering into or upon or from inspecting any <br />buildings, establishments, enclosures, or premises in <br />the discharge of his duties. <br />(ill) Include, as part of the inspections <br />required by subparagraph (II) of this paragraph (b), <br />all of the following: <br />(A) An inspection of all buildings and <br />enclosures to see that proper receptacles for ashes are <br />provided, to cause all rubbish or other inflammable <br />material to be properly removed or disposed of, and <br />to make such suggestions and issue such orders b tre <br />owners or occupants of buildings as, in the opinion of <br />suchmspecting officer, will render the same safe <br />from fIre; <br />(B) An inspection of the surroundings of <br />boilers and other heating apparatus in any building to <br />ascertain whether all woodwork is properly protected <br /> <br />r <br /> <br />Page 4 <br /> <br />November, 20(.1 <br />
