In other words, the owner of a water right may beneficially use the water, with <br />the unconsumed portion of the water used returning to the stream for use by others. The primary value of <br />a water right derives from its relative priority with respect to other water rights, and the right to the use of <br />the water, not the continuous tangible possession of the water itself. SignifIcant components of the value <br />of a water right also arise from the location of its point of diversion and its historical use. <br /> <br />III. Keesee Ditch Water Rights <br /> <br />The Keesee Ditch diverts from the mainstem of the Arkansas River about fIve miles below John <br />Martin Dam. Its decreed point of diversion is on the south side ofthe Arkansas River near the center of <br />Section 6 in the NWY<iSEY<i of Section 6, Township 23 South, Range 48 West of the 6th P.M. in Bent <br />County, Colorado. At the present time, the Keesee Ditch and the Fort Bent Ditch share a common <br />diversion works. <br /> <br />The Keesee Ditch has three separate priorities. The fIrst two priorities were adjudicated on July <br />1, 1895, by the Bent County District Court in the original adjudication of water rights in Water District No. <br />67. In that adjudication, the Keesee Ditch was awarded Priority No.1 with an appropriation date of <br />March 13, 1871, for 9.0 c.f.s., and Priority No.4 with an appropriation date of December 1883 for 4.3 <br />c.f.s. These two priorities were decreed for irrigation of 600 acres underlying the ditch. The third priority <br />for the Keesee Ditch was adjudicated on October 14, 1918, in a supplemental adjudication by the Bent <br />County District Court. That decree awards the Keesee Ditch an additional 15 c.f.s. with an appropriation <br />date of September 3, 1893, forirrigation of an additiona1800 acres, for a total oft ,400 acres decreed to <br />be served by the Keesee Ditch Water Rights. <br /> <br />Priority No. 1 of the Keesee Ditch is the most senior priority in Water District No. 67 and Priority <br />No.4 is the third or fourth most senior priority in Water District No. 67. The 15 c.f.s. priority is, however, <br />among the most junior priorities in Water District No. 67 and therefore provides water in priority only <br />during peak flows or in the wettest of years. <br /> <br />The Keesee Ditch has an Article II Storage Account under the 1980 Operation Plan for John <br />Martin Reservoir, as amended. Under the 1980 Operating Plan, the Keesee Ditch is allocated 2.3 % of <br />the Conservation Storage allocated to Colorado Water District No. 67 ditches. <br /> <br />The senior priorities of the Keesee Ditch ensure that it has a good water supply, even in years of <br />drought. For the period 1950 through 2000, the average annual diversions by the Keesee Ditch were <br />5,574.2 acre-feet. The lowest annual diversions were 2,452 acre-feet in 1966, and the greatest annual <br />diversions were 10,218 acre-feet in 2000. In the drought of2002, the Keesee Ditch diverted 5,777 acre- <br />feet, slightly more than the long-term average.
