Paddock, of Carlson, Hammond & Paddock, L.L.C., and Bill Milenski ofMilenski Appraisal Service, <br />Inc., Swink, Colorado, to prepare a report on the estimated fair market value of the Keesee Ditch Water <br />Rights, the current place of use of which is in Bent County, Colorado. Mr. Paddock is an attorney <br />experienced in water law. Mr. Milenski is an agricultural consultant and a certified general appraiser. This <br />report is a self-contained appraisal of water rights only. <br /> <br />DEFINITION OF MARKET VALUE <br /> <br />Market Value may be defIned as: <br /> <br />The most probable price a property would bring in a competitive and open market <br />under all conditions requisite to a fair sale when both Buyer and Seller act <br />prudently and knowledgeably, assuming thatthe price is not affected by other than <br />customary factors. <br /> <br />Implicit in this definition is the consummation of a sale as of a specified date and the passing of title <br />from Seller to Buyer under conditions whereby: <br /> <br />Page 6 of 66 <br />
