RESOLUTION OF THE BOARD OF TRUSTEES OF TFi:E TOWN OF KREMMLING
CONFIRMING OPERATION OF THE TOWN'S WATE~ AS A COLORADO
CONSTITUTION ARTICLE X, SECTION 20 "ENTERPr E FUND," .

WHEREAS, the Town ofKremmling exercises its ~ta tory authority to own, maintain,
and operate a water system and engage in the diversion, st~ra e, carriage, delivery, distribution,
collection, treatment, use, reuse, augmentation, exchange, or ischarge of water, including
provision of wholesale or retail water services and the acq'fsi 'on of water or water rights;

WHEREAS, the Town ofKremmling has separatelt apcounted for the activities related to
the water system by specific funds and accounts sePanlte frpI1j1 the Town's General Fund;

WHEREAS, the Town's water fund receives less + 10 percent of its annual revenue in
grants from all Colorado state and local governments combfed; ,

WHEREAS, the government water activity busines, owned by the Town is authorized to
issue revenue bonds; !

WHEREAS, the Town's water activity business is 1 "water activity enterprise" under
C.R.S. Article 45.1 ofTitle 37; I

WHEREAS, the Board of Trustees of the Town of emmling wishes to confinn the
Town's intent and operation of its government water activi business as an enterprise under
Colorado Constitution Article X, Section 20;

THEREFORE, BE IT RESOLVED:

1. The Town ofKremmling's water activity bu iness shall continue to be designated a
Colorado Constitution Article X, Section 20 "Enterprise," d operated to continue to qualifY as
a "Enterprise" under the state constitution;

2. The Town ofKremmling's accounting and dit system shall continue to segregate
the water activity as a separate accounting fund;

3. The government water activity busiriess shall also be lmown as a "Water Activity
Enterprise" defined in C.R.S, ~ 37-45.1-105, and shall enjoy and exercise the various authorities
and powers set forth in said Article 45,1 of Title 37, in addition to the authority and powers of the
Town by Title 31, Colorado Revised Statutes.
