CI-LAIJGES IN STA'l'US OF HATER ALI.O'll.1ENTS <br /> <br />Proj ect i'Tater has been allotted to specific tracts of land wi thin the District insofar <br /> <br /> <br />as possible in accordmlce with petitions originally filed in 1964 by the then 0 wners <br /> <br /> <br />of the land to be irrigated. Once approved by the Bureau of Reclamation and granted <br /> <br /> <br />by the District board of directors, an allotment attaches to the land and subjects <br /> <br /> <br />that land to an annual assessment for construction, operation and maintenance of the <br /> <br /> <br />Project, which assessment is collected along lrJith other taxes on the property. <br /> <br />An allotment of one acre foot of water means that the water user is entitled to bene- <br /> <br /> <br />ficial use of 1/10,384 of the annual supply of Project irrigation water availbble to <br /> <br /> <br />the District and approved for distribution by the board of directors. Payment for <br /> <br /> <br />the water is not reduced because of a shortage of Project water, and no liability <br /> <br /> <br />",naIl accrue against the District, the United States or their officers, agents and <br /> <br /> <br />employees as a result thereof. <br /> <br />A Project water allotment may be transferred by deed whenever the entire tract of <br /> <br />land to which it has attached is conveyed from one o\mer to another. But an allot- <br /> <br /> <br />ment to a specific tract of land can be changed or modified only Hhen the property <br /> <br />involved is divided in ownership or when it is moved to other land than that to which <br /> <br /> <br />it is already attached. As provided by law, only the District board is given the <br /> <br /> <br />authority to reallocate 0 r transfer the wa ter supply of the District. Such mod- <br /> <br /> <br />ifications or changes must be made by action and order of the board of directors, and <br /> <br /> <br />in addition the approval of the United States nlust be obtained pursuant to the pro- <br /> <br /> <br />v~sions of the repayment contract between the United States and the District. <br /> <br />,\'h,,'never an entire tract of land is conveyed from one party !bo another, the allotment <br />
