petition, the answers and objections of said respondents, and the
evidence present€d, and all questions of law and of rigbt connected

therewith, doth find that the prayer of. the petition herein should
be granted, and doth further find particularly as follows:
1. That the said peti Uoner has acquired and is the owner
of 2.89 cubic feet of water per second of time pertaining to
Priority No.1, in District NO.4, of date November, l86l,and
allowed by decree of court entered the 8th day of May, 188), in
the District Court of Boulde~~ll86rorado, to that certain
ditch or canal known as the Big Thompson Vitch No.1; the headgate
of the said ditch being located at and in Section 22, Township 5
North, Range 68 West, in the cOWlt~r of Larimer, State of Colorado;
that said 2.89 cubic feet of water has for more than ten years

last past been in part diverted and used by means of the liillsboro

ditch whose headgate is located in Section~21, ~ownship 5 North, Range
68 West; that the water allowed to be diverted under said !Jrior-
ity and decree, particularly the said 2.89 cubic feet of water per
second of time, parcel of th~ SfUJle, has been diverted and used
continuously during the irrigation season of each and every year
from the time of the rendition of said decree up to the present
time by the soid petitionor find Ilia predecessors in interest end
