PROPOSED TERMS AND CONDITIONS

The following terms and conditions are proposed to protec:t other vested water rights in the Big
Thompson and Little Thompson drainage basins.

1. Applicant shall install appropriate measuring and recording devices, as required by the Division
Engineer, in order to adequately administer the subject water rights.

2. Applicant shall institute a daily accounting system recorded in the format similar to that attached
hereto as Appendix D, or such other appropriate fomlat acceptable to the Water Commissioner,
the Division Engineer for Water Division No.1 and parties to this proceeding.

3. The subject water rights shall be diverted from the Big Thompson River only during the periods
when the water was historically diverted.

4. The applicant's municipal consumptive use of the subject water rights shall not exceed the
historical consumptive use of the subject water rights over an appropriate time period to be
dete!:.,mined by the water court.

5. The court shall maintain retained jurisdiction over the: question of injury to the vested water
rights of others for a period of five years from the date of the decree.
