<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I' <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />OJ233S <br /> <br />member and is obligated to follow the guidelines declared by the WSCC. <br /> <br />43 CFR Part 431: <br /> <br />The "General Regulations for Power Generation, Operation, Maintenance, and Replacement <br />at the Boulder Canyon Project, Arizona/Nevada," are provided in 43 CFR Part 431. <br />Although Reclamation cannot violate this or any CFR, such CFR's are subject to revision. <br />The following authorities provided the legal basis for 43 CFR Part 431: <br /> <br />· Reclamation Act of 1902 (32 Stat. 388), <br /> <br />· Boulder Canyon Project Act of 1928 (43 U.S.C. 617 et seq.), <br /> <br />· Boulder Canyon Project Adjustment Act of 1940 (43 U.S.C. 618 et seq.), <br /> <br />· Colorado River Storage Project Act of 1956 (43 U.S.C. 620 et seq.), <br /> <br />· Colorado River Basin Project Act of 1968 (43 U.S.C. 1501 et seq.), and <br /> <br />· Hoover Power Plant Act of 1984 (98 Stat. 1333). <br /> <br />The following definitions are included in ~ 431.3: <br /> <br />Colorado River. Dam Fund or Fund shall mean that special fund established by <br />section 2 of the: Project Act and which is to be used only for the purposes <br />specified in the Project Act, the Adjustment Act, the Colorado River Basin <br />Project Act, and the Hoover Power Plant Act. <br /> <br />Contractor shall mean any entity which has a fully executed contract with <br />W AP A for electric service pursuant to the Hoover Power Plant Act. <br /> <br />Proiect or Boulder Canyon Project shall mean all works authorized by the <br />Project Act, the Hoover Power Plant Act, and any future additions authorized <br />by Congress, to be constructed and owned by the United States, but exclusive <br />of the main canal and appurtenances authorized by the Project Act, now <br />known as the All-American Canal. <br /> <br />Replacements shall mean such work, materials, equipment, or facilities as <br />determined by the United States to be necessary to keep the Project in good <br />operating condition, but shall not include (except where used in conjunction <br />with the word "emergency" or the phrase "however necessitated") work, <br />materials, equipment, or facilities made necessary by any act of God, or of the <br />public enemy, or by any major catastrophe. <br /> <br />32 <br />
