Reclamation will request a 120- <br />day extension to allow for public review and comment of t;he Draft BO. <br />Reclamation will publish a notice in the Federal Registel~ and issue a news <br />release announcing the availability of the Draft BO for comment. <br /> <br />STEP 6 _ PUBLIC COMMENT ON DRAFT BIOLOGICAL OPINION. (Estimated date for close <br />of comment period: January 15, 1997). The Draft BO will be made available for <br />comment for 45 days, with directions that comments must be submitted to <br />Reclamation. Reclamation will consider comments pertaining to any errors ,.)j <br />fact in the biological data or the proposed action and whether (1) any <br />proposed RPA's and/or RPM's avoid the likelihood of jeopardy and adverse <br />modification of critical habitat and/or reduce incidental take, (2) any <br />proposed RPA's and/or RPM's can be implemented in a manner consistent with the <br />intended purpose of the action, (3) any proposed RPA's and/or RPM's can be <br />implemented in a manner consistent with the scope of the agency's legal <br />authority and jurisdiction, and (4) any proposed RPA's and/or RPM's are <br />economically and technologically feasible. <br /> <br />STEP 7 - RESPONSE TO COMMENT ON DRAFT BIOLOGICAL O.PINION. (Estimated date: <br />March 1, 1997). Reclamation will review comments on the Draft BO and decide <br />which constitute new or significant information. It will be Reclamation's <br />responsibility to decide if comments are relevant to consultation, in terms of <br />the action, findings, and recommendations in the Draft BO, and to forward to <br />FWS any amendments to the proposed action and/or requests for changes in RPA's <br />and/or RPM's. Reclamation will respond to letters of comment received on the <br />Draft BO. <br /> <br />STEP 8 - FWS PROVIDES FINAL BIOLOGICAL OPINION TO RECLAMATION. (Estimated <br />date: April 15, 1997). FWS will consider Reclamation's comments and requests <br />in developing a final BO. <br /> <br />STEP 9 - RECLAMATION'S RESPONSE TO THE FINAL BIOLOGICAL OPINION. (Estimated <br />date: May 15, 1997). .
