The <br />application appears to be a study or analysis of a non - structural activity rather than a nonstructural <br />activity. Please clarify. <br /> <br />In Part B.2 (b) the applicant discusses a lease program to municipal and other u sers. Please describe <br />what effect if any is anticipated for those who wish to sell water rights rather than lease. <br /> <br />In Part B.4 please explain the basis for the geographic boundary for participants as being set between <br />Pueblo and John Martin Reservoirs. <br /> <br />In Part B.4 (A) 2 please provide more information regarding the statement that the Lower Arkansas <br />Valley will acquire water that might be sold or permanently transfer r ed out of the basin. Will this <br />principle adversely affect those who wish to access the wat er market outside the basin or who wish to <br />sell water rights? If not , why not ? P lease address in terms of threshold criteria b. <br /> <br />Please explain why requiring a right of first refusal will not diminish or impac t the value of the water <br />rights; what if the hig hest and best market is outside the basin? How will the water right holder be <br />compensated? Please also explain how conditioning the participating water user to not purchase and <br />transfer irrigation water does not diminish or i mpair the water ma r ket, water value and m ovement or <br />use of water. <br /> <br />Please explain what is meant on Page 7 when it indicates that the municipal and other water users <br />“would be asked” to make those water rights available to the program. Does this condition t he <br />municipal or other users access to other water market? <br /> <br />Please explain how cooperative negotiations will maximize the amount of water that can be leased. It <br />appears that it could maximize the value for the participants but explain how that brings people who <br />wish to sell into the market and those who may wish to lease on their own terms. <br /> <br />Under item F on Page 7 it appears that this process could impair those water users that are seeking a <br />purchase of water rights to meet the long - term needs of the new end user(s).
