ATTACHMENT C <br />Lower Colorado River Basin Intentionally Created Surplus Forbearance Agreement <br />The State of Arizona, acting through the Arizona Department of Water Resources <br />("ADWR"); the Palo Verde Irrigation District ("PVID"); the Imperial Irrigation District <br />("IID"); The City of Needles; the Coachella Valley Water District ("CVWD"); The <br />Metropolitan Water District of Southern California ("MWD"); the Southern Nevada Water <br />Authority ("SNWA"); and the Colorado River Commission of Nevada enter into this Louver <br />Colorado River Basin Intentionally Created Surplus Forbearance Agreement ("Forbearance <br />Agreement") as follows: <br />Recitals <br />A. The purposes of this Forbearance Agreement are to: <br />Encourage the efficient use and management of Colorado River water, and to <br />increase the water supply in Colorado River system reservoirs, through the <br />creation, release, and use of Intentionally Created Surplus ("ICS"); <br />2. Help avoid shortages to the Lower Basin; <br />3. Benefit both Lake Mead and Lake Powell; and <br />4. Increase the surface elevations of both Lakes Powell and Mead to higher <br />levels than would have otherwise occurred. <br />Assure any Contractor that invests in conservation or augmentation to create <br />ICS under this Forbearance Agreement that no Contractor within another state <br />will claim the ICS created by the Contractor. <br />
