The authority shall be deemed the <br />agency head for the purpose of reviewing an initial order of the <br />panel and shall review all such initial orders. <br />(c) If the authority approves the water transfer and if there is <br />no judicial review pending therefrom, the chief engineer shall sub- <br />mit the same to the legislature for review as provided for in K.S.A. <br />82a-1301 et seq., and amendments thereto. Montana <br /> <br />MONT. CODE. ANN. ~~ 85-2-311 (1989), 85-2-316 (1991). <br />The Montana statutes, in brief, provide as follows: <br />MONT. CoDE ANN. ~ 85-2-311 (1989). Criteria for issuance of a <br />permit. <br />Appropriations for use outside of Montana require clear and <br />convincing evidence that: <br />1. The applicant has complied with the applicable in-state cri- <br />teria and procedures. <br />2. The proposed use is not contrary to water conservation in <br />Montana. <br />3. The proposed use is not detrimental to the public welfare of <br />Montana citizens. <br />In making its determination of whether the proof regarding <br />items 2 and 3 is clear and convincing, the department of natural <br />resources and conservation is to consider the following: <br />a. Whether there are present or projected water shortages <br />within Montana, <br />b. Whether the water to be taken could feasibly be transported <br />to alleviate water shortages in Montana, <br />c. The supply and sources available to the applicant in state <br />where the water is to be used. <br />d. The demands on the applicant's supply in the state where <br />the water is to be used. <br />MONT. CODE ANN. ~ 85-2-316 (1991) specifies the same conditions <br />for reservations of water. MONT.
