Consent Agenda Item l.c <br />Case No. 4-07CW 133: Application of Elk River Ranches <br />Application Summary <br />This is an application for a plan for augmentation, ground water right, storage right and change of <br />water right on Ohio Creek, near Gunnison. The Applicant seeks to change its interest in the water <br />rights associated with the Lone Pine Ditch, the May Bohm and Enlarged M B H P, and the Purrier <br />Ditch to be used for augmentation to co~~er evaporati~~e depletions caused by the interception of <br />ground water by Elk Ri~~er Pond Nos. 1 and 3. The Applicant also seeks absolute ground water <br />rights for said ponds. <br />CWCB Appropriation <br />The CWCB holds the following instream flow water right that could be injured by this application: <br />CWCB Stream/Lake Amount Approp. Watershed County <br />Case No. (cfs) Date <br />4-80CW112B Ohio Creek 12 3/17/80 Gunnison Ri~~er Gunnison <br />Potential for Injury <br />The Applicant's proposed plan for augmentation may injure the Board's instream flow water right <br />on Ohio Creek by not replacing out-of-priority depletions in time, place and amount. The <br />Applicant's proposed change of water rights may result in an expansion of use that could injure the <br />Board's instream flow water right on Ohio Creek. <br />Other Objectors <br />The Upper Gunnison River Water Conservancy District also filed a Statement of Opposition to this <br />application. <br />
