Consent Agenda Item l.a <br />Case No. 1-07CW232: Application of Cynthia E. Johnson and Richard A. Johnson <br />Application Summary <br />This is an application for change of water right and approval of a plan for augmentation in Boulder <br />County bet~-een Eldora Springs and Boulder. <br />1. The Applicants seek a ground water right (15 gpm) for the Creekside Ranch Pond, which <br />may intercept ground water. The estimated evaporation is 0.102 AF per year; <br />2. The Applicants seek a surface water right (1 cfs) to fill the Pond above the water table; <br />3. The Applicants seek a change of water rights represented by 1/a share of the Howard Ditch <br />Company (change of use and change of point of di`~ersion); and, <br />4. The Applicants seek appro~~al of a plan for augmentation to replace pond e~~aporation. <br />The Applicants' proposed uses of conditional ground water and surface water rights are for <br />recreation, fish and wildlife, piscatorial, stock watering, irrigation and fire protection; and to use, <br />reuse, and successively use with an appropriation date of September 28, 2007. The change of use <br />includes a change in the point of diversion for uses listed above, as well as for storage, <br />augmentation, replacement and exchange. The Applicants' proposed plan for <br />augmentation may injure the Board's instream flow water right on South Boulder Creek by not <br />replacing depletions in time, place and amount due to the exposure of ground water and other <br />evaporati~~e losses. <br />Other Objectors <br />The City of Boulder, the Water Users Association of District No. 6, the City of Louisville, and the <br />City of Lafayette also filed Statements of Opposition to this application. <br />
